PURCHASE OPTIONS AND CANCELLATION POLICY

1. OVERVIEW
This Purchase Options and Cancellation Policy (“Policy”) outlines the purchase options available through elunalabs.com (the “Website”), the terms governing subscription services, and your rights and procedures for cancelling orders and subscriptions. This Policy is incorporated into and forms part of Elunalabs’s Terms and Conditions. By placing an order or enrolling in a subscription through the Website, you acknowledge that you have read, understood, and agreed to this Policy.
2. PURCHASE OPTIONS
Elunalabs offers the following purchase options through the Website:
2.1 One-Time Purchase
You may purchase products on a one-time, non-recurring basis. One-time purchases are charged to your payment method at the time of checkout. No future charges will be made unless you place a new order or enroll in a subscription.
2.2 Subscription Purchase (Auto-Renewal)
You may enroll in a subscription plan that provides automatic recurring shipments of selected products at a frequency of your choosing. Available subscription intervals include, but are not limited to: every 7 days; every 14 days; every 30 days; every 60 days; and every 90 days. Additional intervals may be made available from time to time.
By enrolling in a subscription, you authorize Elunalabs to automatically charge your payment method at the selected billing interval for the recurring shipment of your selected products. Subscriptions will continue automatically at the then-current rate until you cancel in accordance with this Policy.
3. SUBSCRIPTION ENROLLMENT AND DISCLOSURE
At the time of enrollment in a subscription, the following information will be clearly and conspicuously disclosed to you before you complete your purchase: the fact that charges will recur automatically; the billing frequency (e.g., every 7, 14, 30, 60, or 90 days); the amount to be charged at each billing interval; and the cancellation policy and procedures.
You will be required to take an affirmative action (such as checking an unchecked box or clicking a clearly labeled button) acknowledging the recurring nature of the subscription and the cancellation terms before completing your purchase. Your affirmative action constitutes express consent to recurring charges.
FOR CANADIAN CUSTOMERS: This disclosure complies with applicable Canadian consumer protection legislation, including the Ontario Consumer Protection Act, 2002 (S.O. 2002, c. 30, Sch. A) and equivalent provincial legislation regarding internet agreements and disclosure requirements for recurring charges.
4. SUBSCRIPTION PRICING
Subscription pricing is confirmed at the time of enrollment and will be displayed on the checkout page. Elunalabs reserves the right to change subscription pricing at any time. If pricing changes, Elunalabs will provide advance notice to active subscribers as required by applicable law. You will have the opportunity to cancel your subscription before any price increase takes effect. Continued enrollment in the subscription after a price change takes effect constitutes your acceptance of the new pricing.
5. AUTOMATIC RENEWAL
UNLESS YOU CANCEL YOUR SUBSCRIPTION IN ACCORDANCE WITH THIS POLICY, YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE THEN-CURRENT RATE AND AT THE SAME BILLING INTERVAL YOU SELECTED AT CHECKOUT. YOU WILL NOT RECEIVE AN ADDITIONAL REMINDER PRIOR TO EACH RENEWAL UNLESS REQUIRED BY APPLICABLE LAW.
For Canadian customers in jurisdictions that require advance notice of automatic renewal (including under the Ontario Consumer Protection Act, 2002 or equivalent provincial legislation), Elunalabs will provide notice in accordance with applicable law.
6. ACCOUNT UPDATER
Elunalabs may use an automatic account updater service provided by our payment processor. This service may update your stored payment information (e.g., card number or expiration date) if your card issuer provides updated information. If your payment information is updated, you authorize Elunalabs to charge the updated payment method for future subscription renewals. If you do not wish to have your payment information automatically updated, you must remove your stored payment method or cancel your subscription before the next billing date.
7. HOW TO CANCEL A SUBSCRIPTION
You may cancel your subscription at any time. To avoid being charged for the next scheduled shipment, cancellation must be completed at least twenty-four (24) hours before your next billing date.
You may cancel through any of the following methods: (1) logging into your account on elunalabs.com and following the clearly labeled cancellation instructions in the subscription management portal; (2) using the “Cancel Subscription” feature in your account dashboard; (3) emailing support@elunalabs.com with your name, order number, and a request to cancel; or (4) using the third-party subscription management portal identified in your order confirmation email.
ELUNALABS WILL NOT REQUIRE YOU TO CALL A LIVE REPRESENTATIVE TO CANCEL YOUR SUBSCRIPTION.
Cancellation requests submitted through the account portal are effective upon confirmation. Cancellation requests submitted via email will be processed within two (2) business days of receipt.
7.1 Effects of Cancellation
After cancellation: no future recurring charges will be made to your payment method; no additional shipments will be sent after the current billing cycle; and your access to any subscription-exclusive pricing, discounts, or benefits will terminate at the end of the current billing period. Cancellation does not entitle you to a refund for the current billing period’s charge or for any prior charges, unless otherwise required by applicable law.
8. CANCELLATION OF ONE-TIME ORDERS
If you wish to cancel a one-time order after it has been placed, please contact our Customer Support team at support@elunalabs.com as soon as possible. Because Elunalabs frequently ships the same day that orders are placed, we cannot guarantee that cancellations can be accommodated once the order has entered the fulfillment process.
If your order has not yet shipped, we will cancel the order and issue a full refund to your original payment method. If your order has already shipped at the time of your cancellation request, the order cannot be cancelled and will be subject to the standard return and refund provisions of Elunalabs’s Return and Refund Policy.
9. FAILED PAYMENTS
If a recurring subscription charge fails to process (due to insufficient funds, expired card, declined transaction, or any other reason), you authorize Elunalabs to: retry the charge on the same or a subsequently updated payment method; contact you at the email address or phone number on file to request updated payment information; and suspend future shipments until a valid payment method is provided and the outstanding charge is successfully processed.
Your continued enrollment in a subscription after a failed payment constitutes reaffirmation of your authorization to charge your payment method. Unpaid balances may be referred for collection where permitted by law.
10. SUBSCRIPTION MODIFICATIONS
You may modify your subscription at any time by logging into your account or contacting support@elunalabs.com. Modifications may include: changing the product(s) in your subscription; changing the quantity of products; changing the billing and shipping interval; updating your shipping address; and updating your payment method. Modifications take effect on the next billing cycle unless otherwise specified.
11. PAUSING A SUBSCRIPTION
Elunalabs may, at its discretion, offer the option to pause a subscription for a specified period. If available, the pause feature can be accessed through your account dashboard on elunalabs.com. During a pause, no charges will be made and no shipments will be sent. Your subscription will automatically resume at the end of the pause period unless you cancel before that date. The availability of the pause feature is not guaranteed and may be modified or discontinued at any time.
12. REFUNDS FOR SUBSCRIPTION ORDERS
Refunds for subscription orders are evaluated on a case-by-case basis and are subject to Elunalabs’s Return and Refund Policy. Elunalabs reserves the right, in its sole and absolute discretion, to deny refund requests for subscription shipments that have already been delivered. If a subscription shipment is eligible for return, it must comply with all requirements of Elunalabs’s Return and Refund Policy, including the 90-day eligibility window and product condition requirements.
13. PROMOTIONAL AND TRIAL OFFERS
Elunalabs may, from time to time, offer promotional pricing, discounted first-shipment offers, or trial subscription offers. The specific terms of each promotional offer will be disclosed at the time of enrollment. Unless otherwise stated: promotional pricing applies only to the first shipment or billing cycle; subsequent billing cycles will be charged at the then-current standard subscription rate; and all promotional and trial offers are subject to these Terms, the Terms and Conditions, and the Return and Refund Policy.
Elunalabs reserves the right to limit promotional offers to one per customer, per household, or per payment method. Elunalabs reserves the right to terminate or modify promotional offers at any time without notice.
14. CANADIAN CONSUMER PROTECTION RIGHTS
Customers residing in Canada may have rights under applicable federal and provincial consumer protection legislation that cannot be excluded, restricted, or modified by agreement. These include, but are not limited to:
Under the Ontario Consumer Protection Act, 2002: the right to receive clear disclosure of all material terms of an internet agreement before completing a transaction; the right to cancel an internet agreement within seven (7) days of receiving a copy of the agreement if the required disclosure was not provided; the right to cancel if goods are not delivered within thirty (30) days of the delivery date specified in the agreement (or, if no date is specified, within thirty (30) days of the date of the agreement); and the right to receive a refund within fifteen (15) days of cancellation.
Under the Quebec Consumer Protection Act: the right to cancel a distance contract within ten (10) days of delivery; the right to cancel if the merchant fails to deliver the goods within thirty (30) days of the agreed-upon date; and the right to demand a refund within fifteen (15) days of cancellation. Additionally, in Quebec, arbitration clauses in consumer contracts may be unenforceable, and class action waivers may not apply.
Under the British Columbia Business Practices and Consumer Protection Act: the right to cancel a future performance contract if goods are not delivered within thirty (30) days of the promised delivery date; and the right to receive a refund within fifteen (15) days of cancellation.
Under the Alberta, Saskatchewan, and other provincial consumer protection legislation: similar rights regarding disclosure, cancellation, and refunds for internet or distance sales agreements may apply. Please consult the applicable provincial legislation or contact your provincial consumer protection authority for details.
TO THE EXTENT THAT ANY PROVISION OF THIS POLICY CONFLICTS WITH ANY MANDATORY PROVISION OF APPLICABLE CONSUMER PROTECTION LEGISLATION, THE MANDATORY PROVISION SHALL PREVAIL. ELUNALABS DOES NOT INTEND TO WAIVE, EXCLUDE, OR LIMIT ANY RIGHTS THAT CANNOT BE WAIVED, EXCLUDED, OR LIMITED UNDER APPLICABLE CANADIAN LAW.
15. GOVERNING LAW
This Policy shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein for Canadian residents and transactions, and by the laws of the applicable U.S. state for U.S. residents and transactions. This Policy is subject to Elunalabs’s Terms and Conditions, which contain additional provisions regarding dispute resolution, arbitration, limitation of liability, and governing law.
