RETURN AND REFUND POLICY

1. OVERVIEW

Elunalabs wants you to be satisfied with your experience with us. This Return and Refund Policy (“Policy”) outlines the terms and conditions under which you may return products purchased through elunalabs.com (the “Website”) and request a refund, exchange, or credit. This Policy is incorporated into and forms part of Elunalabs’s Terms and Conditions. By placing an order through the Website, you acknowledge that you have read, understood, and agreed to this Policy.

2. RETURN ELIGIBILITY WINDOW

You may submit a return or refund request within ninety (90) days from the date of order fulfillment (the date your order was shipped). After the 90-day period has elapsed, all sales are considered final and no returns, refunds, or exchanges will be accepted.

To be eligible for a return, the following conditions must be met: (a) the return request must be submitted within the 90-day eligibility window; (b) the product must be in its original, unopened, and unused condition, unless the product was received damaged, defective, or incorrect; (c) the product must be in its original packaging with all labels, seals, and tags intact; and (d) you must provide your order number and the email address associated with your purchase.

3. HOW TO REQUEST A RETURN OR REFUND

To initiate a return or refund request, please contact our Customer Support team by emailing support@elunalabs.com with the following information: your full name; your order number; the email address associated with your order; the product(s) you wish to return; the reason for your return request; and any supporting documentation (such as photographs of damaged or defective products).

Our Customer Support team will review your request and respond within three (3) to five (5) business days. If your return is approved, you will receive instructions on how and where to ship the product back to us. Do not ship any product back to us without first receiving return authorization from our Customer Support team. Unauthorized returns may be refused or discarded.

4. DAMAGED, DEFECTIVE, OR INCORRECT PRODUCTS

If you receive a product that is damaged, defective, or incorrect, please contact us at support@elunalabs.com within fourteen (14) days of receiving your order. When contacting us, please include: your order number; a description of the issue; and photographs clearly showing the damage, defect, or incorrect product received.

Upon verification of the issue, Elunalabs will, at its sole discretion, offer one of the following resolutions: a full refund to your original payment method; a replacement product shipped at no additional cost to you; or a store credit for the value of the affected product.

If the damage or defect is determined to have been caused by the shipping carrier, Elunalabs may, at its discretion, file a claim with the carrier on your behalf. However, Elunalabs is not responsible for damage caused by third-party carriers after the product has been delivered to the carrier for shipment.

5. RIGHT TO REFUSE RETURNS

ELUNALABS RESERVES THE RIGHT, IN ITS SOLE AND ABSOLUTE DISCRETION, TO REFUSE, REJECT, OR DENY ANY RETURN, EXCHANGE, OR REFUND REQUEST FOR ANY REASON OR FOR NO REASON, WITHOUT BEING REQUIRED TO PROVIDE AN EXPLANATION OR JUSTIFICATION TO THE CUSTOMER.

Factors that may be considered when evaluating a return request include, but are not limited to: suspected fraud or abuse of the return process; excessive or abnormal return history associated with your account or payment method; product condition upon return (e.g., opened, partially consumed, tampered with, or missing components); evidence of product misuse, alteration, or improper storage; failure to comply with return procedures outlined in this Policy; return requests submitted outside the 90-day eligibility period; and any other factor that Elunalabs deems relevant in its assessment.

THIS RIGHT TO REFUSE RETURNS IS IN ADDITION TO, AND DOES NOT LIMIT, ANY OTHER RIGHTS OR REMEDIES AVAILABLE TO ELUNALABS UNDER THE TERMS AND CONDITIONS OR AT LAW.

FOR CANADIAN CUSTOMERS: Nothing in this section is intended to limit any rights you may have under applicable provincial consumer protection legislation regarding returns, refunds, or cancellations that cannot be waived or modified by agreement. Where mandatory consumer protection rights apply (including under the Ontario Consumer Protection Act, 2002, the Quebec Consumer Protection Act, or equivalent provincial legislation), those rights shall prevail over this Policy.

6. NON-REFUNDABLE ITEMS AND CHARGES

The following items and charges are non-refundable under any circumstances: (1) items marked “final sale,” “clearance,” or “nonreturnable” at the time of purchase; (2) standard shipping fees; (3) expedited or express shipping fees; (4) package loss warranty or shipping insurance fees; (5) priority order processing fees; (6) gift cards, or any portion of an order paid for using a gift card; and (7) any promotional or free items included with your order.

If you received a discount, promotional pricing, or coupon code on your order, the refund amount will be calculated based on the actual amount paid after the discount, not the original retail price.

7. REFUND PROCESSING

7.1 Processing Timeline

Once your return has been received and inspected by our shipping department, we will notify you of the approval or rejection of your refund. If approved, your refund will be processed within ten (10) business days of receiving the returned product. Refunds will be issued to your original payment method.

Please note that after a refund has been processed by Elunalabs, it may take an additional five (5) to ten (10) business days for the refund to appear on your statement, depending on your financial institution or payment provider. Elunalabs is not responsible for delays in posting caused by your bank, credit card issuer, or payment provider.

7.2 Refund Methods

Refunds will be issued using the same payment method used for the original purchase. If the original payment method is no longer available (e.g., expired credit card, closed account), Elunalabs may, at its discretion, issue the refund via an alternative method, such as store credit. Elunalabs does not issue refunds in cash, by check, or via wire transfer.

7.3 Partial Refunds

Elunalabs may, at its sole discretion, issue a partial refund in the following circumstances: products returned in a condition other than their original state (e.g., opened, partially consumed, or with damaged packaging); products returned without original packaging, labels, seals, or tags; returns in which only some items in a multi-item order are eligible for a refund; or any other circumstance in which Elunalabs determines that a full refund is not warranted.

8. RETURN SHIPPING

Unless the return is the result of an error by Elunalabs (such as a damaged, defective, or incorrect product), the customer is responsible for all return shipping costs. Return shipping costs are non-refundable.

Elunalabs recommends that you use a trackable shipping method and purchase shipping insurance for your return. Elunalabs is not responsible for returned products that are lost, stolen, or damaged in transit. If a returned product does not arrive at our facility, no refund or exchange will be issued.

For Canadian customers returning products to a U.S.-based warehouse, any customs duties, brokerage fees, or cross-border shipping charges incurred on the return shipment are the sole responsibility of the customer and are non-refundable.

9. EXCHANGES

If you would like to exchange a product for a different item, please contact our Customer Support team at support@elunalabs.com. Exchanges are subject to product availability and are processed at Elunalabs’s sole discretion. If the replacement product is of greater value than the original product, you will be required to pay the difference. If the replacement product is of lesser value, a store credit may be issued for the difference at Elunalabs’s discretion.

Exchanges follow the same eligibility requirements and 90-day window as returns outlined in Section 2 of this Policy.

10. SUBSCRIPTION CANCELLATIONS AND REFUNDS

If you are enrolled in an Elunalabs subscription plan, you may cancel your subscription at any time. To avoid being charged for the next scheduled shipment, you must cancel at least twenty-four (24) hours before your next billing date.

You may cancel your subscription through any of the following methods: logging into your account and using the “Cancel Subscription” feature; emailing support@elunalabs.com; or using the third-party subscription management portal identified at checkout.

Upon cancellation: no future recurring charges will be made; and no additional shipments will be sent after the current billing cycle. If a subscription shipment has already been processed and shipped at the time of your cancellation request, that shipment is subject to the standard return and refund provisions of this Policy.

Refunds for subscription orders are evaluated on a case-by-case basis. Elunalabs reserves the right to deny refunds for subscription shipments that have already been delivered.

FOR CANADIAN CUSTOMERS: Your right to cancel your subscription is not limited by this Policy where applicable consumer protection legislation provides broader cancellation rights, including any cooling-off periods provided under provincial law. Where mandatory consumer protection rights apply, those rights shall prevail.

11. CHARGEBACKS AND PAYMENT DISPUTES

Elunalabs encourages customers to contact our Customer Support team at support@elunalabs.com before initiating a chargeback or payment dispute with their bank or credit card issuer. Our team is committed to resolving issues quickly and fairly.

If you initiate a chargeback or payment dispute without first contacting Elunalabs and allowing a reasonable opportunity to resolve the issue, Elunalabs reserves the right to: contest the chargeback with all available documentation, including delivery confirmation, order records, and communications; suspend or terminate your account; refuse future orders from you; and pursue collection of any amounts owed, including chargeback fees, to the fullest extent permitted by law.

Carrier delivery confirmation shall be deemed conclusive proof of delivery for purposes of resolving chargebacks and claims of non-delivery, even without a signature, as agreed to in Elunalabs’s Terms and Conditions.

12. FRAUD AND ABUSE

Elunalabs takes return and refund fraud seriously. If Elunalabs determines, in its sole discretion, that a customer is engaging in fraudulent, abusive, or deceptive return or refund practices, Elunalabs reserves the right to: deny the return or refund request; suspend or permanently terminate the customer’s account; refuse future orders from the customer; report the activity to applicable law enforcement authorities in Canada and/or the United States; and pursue any and all legal remedies available under applicable law.

Examples of fraudulent or abusive behavior include, but are not limited to: claiming a product was not received when delivery confirmation exists; returning a product that has been materially altered, substituted, or tampered with; filing repeated return requests on similar orders without legitimate cause; making false claims about product damage or defects; and using multiple accounts to circumvent return limits or policies.

13. REGULATORY DISCLAIMERS

Products sold through the Website are dietary supplements manufactured in the United States of America. For customers in the United States, the statements made regarding our products have not been evaluated by the U.S. Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease.

For customers in Canada, the products sold through the Website may not have been evaluated or approved by Health Canada, and may not have been issued a Natural Product Number (NPN) or Drug Identification Number (DIN-HM) unless otherwise expressly stated on the product label. The health-related claims on the Website have not been reviewed or approved by Health Canada’s Natural and Non-prescription Health Products Directorate (NNHPD).

Returns or refund requests based solely on dissatisfaction with product efficacy or health outcomes are subject to Elunalabs’s standard return eligibility requirements and Elunalabs’s right to refuse returns as outlined in Section 5 of this Policy. Elunalabs does not guarantee specific health results, and individual results may vary.

14. CANADIAN CONSUMER PROTECTION RIGHTS

Customers residing in Canada may have rights under applicable federal and provincial consumer protection legislation that cannot be excluded, restricted, or modified by agreement. These include, but are not limited to, rights provided under: the Ontario Consumer Protection Act, 2002 (S.O. 2002, c. 30, Sch. A) (and, once proclaimed in force, the Consumer Protection Act, 2023); the Quebec Consumer Protection Act (R.S.Q., c. P-40.1); the British Columbia Business Practices and Consumer Protection Act (S.B.C. 2004, c. 2); the Alberta Consumer Protection Act (R.S.A. 2000, c. C-26.3); the Saskatchewan Consumer Protection and Business Practices Act (S.S. 2014, c. C-30.2); and equivalent legislation in other provinces and territories.

To the extent that any provision of this Policy conflicts with any mandatory provision of applicable consumer protection legislation, the mandatory provision shall prevail. Canadian customers retain all rights to file complaints with the applicable provincial consumer protection authority.

Nothing in this Policy is intended to waive, exclude, or limit any rights that you may have under applicable Canadian law regarding: the right to return products purchased through internet agreements within any applicable cooling-off period; the right to receive a refund for products that are materially different from their description; the right to a remedy for products that are defective or not of merchantable quality; or any other rights that cannot be waived under applicable provincial consumer protection legislation.

15. GOVERNING LAW

This Policy shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein for Canadian residents and transactions, and by the laws of the applicable U.S. state for U.S. residents and transactions. This Policy is subject to Elunalabs’s Terms and Conditions, which contain additional provisions regarding dispute resolution, arbitration, limitation of liability, and governing law.

16. CHANGES TO THIS POLICY

Elunalabs reserves the right to modify, update, or replace this Return and Refund Policy at any time in its sole discretion. Changes will be effective immediately upon posting to the Website. Your continued use of the Website or purchase of Products after any changes to this Policy constitutes your acceptance of those changes. It is your responsibility to review this Policy periodically. The “Last Updated” date at the top of this Policy indicates when the most recent revisions were made.
